General Counsel Services

As a business owner or professional, you might avoid addressing the legal needs of your company or practice believing it’s too costly or time-consuming to do so. In reality, neglecting these issues often leads to problems that become more expensive and often more challenging to rectify. The Beinhaker Law Firm (the “Firm”) offers its Legal Retainer Program (“LRP”), designed to accommodate any business owner’s or professional’s needs. Our LRP is an arrangement whereby we act as the general counsel for you and your business, on-call and available, for a regular and manageable fee.

Depending on the size of your company and your regular business needs, we will customize our services and determine a monthly fee arrangement that fits within your budget. Some of our monthly “service packs” are listed below:

  • Service Pack #1* – Solos & Professionals. For individual professionals and one-person businesses, this package includes monthly phone consultations, email correspondence and review of any business documents.
  • Service Pack #2* – Small Businesses. For businesses with approximately 2 to 10 employees, this package includes the Service Pack #1, plus monthly unlimited business letter writing and drafting of 2 business documents per month.
  • Service Pack #3* – Professionals. For professionals such as architects and accountants, this package includes Service Packs #1 & #2, plus unlimited business letter writing and unlimited business document preparation. Medical professionals should inquire about our Healthcare Retainer Program.
  • Service Pack #4* – Medium/Large Companies. For organizations with more than 10 employees, this package includes all 3 Service Packs, plus additional services custom-designed to fit your particular needs.

* Fees are determined on a case-by-case basis

As a retainer client, services outside the scope of your service pack will be discounted by 20%. This may include hourly litigation services, estate or other document preparation, or contingency collection activities. Specific details along with terms & conditions are subject to your retainer agreement and will be supplemented with a “short form” retainer addendum as needed. Additional credits and discounts may be available depending on your level of LRP service.

It’s like having your own general counsel, available when you need, at a manageable cost while avoiding the costs and complications of adding staff to your payroll.

Who is appropriate for the program?
Everyone can use proper counsel to manage all of their affairs, but we generally find that for professionals, executives and business owners who earn in excess of $1,000,000 per year and whose net worth exceeds 20 million dollars, our program is a must.  Your unique situation may make the program appropriate for you even if you fall outside these benchmarks.

Will this service replace the need for other attorneys I use currently?
In general terms, we will replace any attorneys who handle any of the issues described above. For matters not handled by our firm, we will hire or introduce you to other attorneys. Examples may include employment law, family law issues, and bankruptcy. At your direction, we will work with outside professionals to resolve your issues.

Will use of this service save me money?
Although the service is designed to improve legal support for a manageable cost, it may save you money due to our replacement of multiple attorneys you may be currently using.

What is the cost of this service?
Fees vary from client to client, depending on the need for regular counsel. Additional services, in excess of your retainer services, are billed at a discount. For more information, contact our office or download our information brochure.

Besides the retainer, are there any other fees involved?
Yes. In addition to the retainer fee which is designed to pay for our time, you will also be charged for any costs or other fees incurred while handling your matters. Such fees include, but are not limited to, filing fees, recording fees, processing fees, use of outside professionals (if needed), etc… These are all detailed in your retainer agreement.

Is the service cancellable at any time?
Yes. Since we bill you at the beginning of each cycle (monthly, bi-weekly, etc…), we require a full cycle’s notice to cancel. We will reserve the right to stay on retainer as long as necessary to conclude open matters or to transfer records to a new law firm (if any).

How do you accept payment?
Since fees are charged on a regular basis (monthly, bi-weekly, etc…), we require that you keep a form of payment on record and receipt for electronic charges will be forwarded by email each cycle. We prefer VISA or MasterCard, but also accept American Express and Discover. Please note that our processing fees are added to each payment.
